Terms of Service

By using mtbrand.co or engaging Montana Brand Co. for services, you agree to these terms. We've written them in plain English on purpose.

Services

We provide website design, digital marketing, and ongoing care services. Project scope, deliverables, and timelines are documented in your statement of work (SOW).

Payment

Project fees are billed 50% to start, 50% on launch — unless your SOW specifies otherwise. Care plans bill monthly. Marketing ad spend is billed direct or invoiced — your call.

Ownership

Once paid in full, you own the final deliverables. Source code, design files, and content are yours. We may include the work in our portfolio unless you ask us not to.

ROI Guarantee

If your new site doesn't outperform the old one on agreed-upon KPIs within 90 days of launch, we work for free until it does. Some conditions apply (we need access to ad spend and analytics data — see your SOW).

Limitation of liability

Our total liability is capped at the fees you've paid us in the last 12 months. We're not liable for lost profits or indirect damages — we are liable for doing our work well, and we take that seriously.

Governing law

These terms are governed by the laws of the State of Montana. Any dispute will be heard in the state or federal courts located in Gallatin County.
